# Controlled Public Beta Terms (DRAFT)

> **DRAFT. NOT reviewed by a lawyer. Not in force.** Version `beta-terms-draft-2026-10-31`. Fahad must have counsel review this before the public launch.

Welcome to the controlled public beta of our PPF and tint shop marketplace ("the app"). This is a beta: anyone can sign up, but features are limited and may change or pause at any time.

## 1. What the app does
- You can find **admin-approved** shops, request quotes and book appointments.
- **During this beta, you pay the shop directly.** The app does not take payment for bookings. Price, tax, warranty and the work itself are between you and the shop.
- Shops are independent businesses, not our employees or agents. We check that a shop is approved, but we do not guarantee its work.

## 2. Your account
- Be 18 or older, give true information and keep your login safe.
- We may limit, pause or close accounts to stop fraud or abuse, including pausing all new bookings at once (our "kill switch").

## 3. Bookings and cancellations
- A booking holds a time with the shop. Cancel or reschedule in the app as early as you can.
- Each shop may show its own cancellation rule before you book. You see it before you confirm.

## 4. Refunds (plain English)
- **Booking-only beta:** since you pay the shop, refunds come from the shop under its own policy and the law. Steps:
  1. Contact the shop through the app's messages and say what went wrong.
  2. If it isn't fixed in 7 days, open an issue in the app ("Report a problem"). We review it, may ask both sides for photos, and may remove a shop that doesn't follow its own policy.
  3. You may also use your card issuer's dispute process, or BAR (bar.ca.gov) for auto-repair complaints.
- **If in-app payments are later turned on** (we will tell you first and ask you to accept updated terms): deposits are refunded to the original card under the cancellation rule shown at booking; a shop no-show means a full refund.

## 5. Disputes about the work
1. Message the shop and allow a reasonable time to fix it.
2. Open an issue in the app with photos. We will look at both sides within 5 business days.
3. If that doesn't resolve it, see section 8.

## 6. Reviews
Reviews must be honest and about your own experience. Shops may not offer anything in return for a review.

## 7. Limits
The app is provided "as is" during the beta. To the extent the law allows, our total liability is limited to the greater of $100 or the fees you paid us (in this beta, normally $0). Nothing here limits rights you have under California law that cannot be waived.

## 8. Resolving disputes with us
- **Talk to us first:** email support and we'll try to resolve it within 30 days.
- **Arbitration (DRAFT, counsel to decide whether to keep it):** remaining disputes go to individual binding arbitration, not class actions.
- **Small claims carve-out:** either side may use small claims court instead.
- **Public injunction carve-out (McGill v. Citibank, 2017):** nothing here waives your right to seek a public injunction in court under California law (for example, the UCL, CLRA or False Advertising Law). Those claims are decided in court, and the rest of the case may be paused while they proceed.
- California law applies.

## 9. Changes
We may update these terms; we'll show the new version and ask you to accept before you book again.

## 10. Privacy
See the Privacy Policy draft (docs/legal/PRIVACY_POLICY_DRAFT.md).
